Huge Airline Price Fixing Fines

The European Commission has imposed fines totalling almost €800m on eleven air cargo carriers including BA, Air France, KLM and Quantas. The airlines were found to have coordinated prices on fuel surcharges and on security charges to their cargo customers over an extended period from December 1999 to February 2006.

The heaviest fine was imposed on Air France and KLM with the BA fine also exceeding €100m.

Taylors have already been instructed in a substantial damages claim by one client seriously affected by the over charging resulting from this cartel. The Commission decision is binding proof of the illegal behaviour of the airlines concerned.

The object of damages is to compensate the victims of the illegal cartel for the loss suffered, ie to put those victims in a position as if the illegal behaviour had not occurred.

Exporters and other significant users of air freight over the 1999 / 2006 period should call Taylors’ head of IP Litigation, Tony Catterall, if they wish to consider a claim.
