Emma Swan
Senior Associate

Role
Emma is a Senior Associate in the Employment Team who takes a dynamic and pragmatic approach to find workable commercial solutions for clients. Emma specialises in all aspects of employment law, with extensive experience of employment tribunal litigation, appearing in Tribunals all over England, Wales and Scotland.

Experience
Emma has recently joined Taylors from Eversheds, Manchester and was previously with Mace and Jones, Liverpool. Her broad range of experience built up working with both private and public sector clients of a variety of sizes in contentious and non-contentious matters covers:

  • Tribunal cases to include breach of contract claims, disability discrimination, sex discrimination, TUPE, unfair dismissal, unlawful deductions.
  • Reviewing, drafting and advising upon employment contracts and policies, consultancy agreements and atypical workers agreements.
  • Advising sector specific  (including Food, Health, IT, Retail and Transport) clients in a variety of situations, to include: - TUPE, redundancies, performance management, long and short term sickness absence, disability discrimination and grievances.
  • Advising on family friendly rights and in particular on maternity rights and flexible working applications.
  • Advising employers on exit strategies for employees and compromise agreements.
  • Providing strategic advice in relation to restructuring and redundancies.

Emma was also the solicitor acting for the Employer in the leading disability discrimination case of Royal Liverpool Children’s Hospital NHS Trust v Dunsby [2006] IRLR 351where it was established that there is no obligation on an employer to disregard disability-related absences in operating a sickness absence procedure although it might in some circumstances it might be reasonable to do so.

Profile
Emma is a Preston girl and lives there with her husband and two young boys. When she isn’t chasing after footballs and hurtling down slides, she enjoys a good book and a glass of wine. Emma is also a keen advocate of retail therapy!

1. Who was your childhood hero?
My mum – and still is because she is an intelligent and wise woman with the generosity and patience of a saint.

3. What was your first car?
A mazda MX5

4. What is your dream holiday destination?
Somewhere hot with a white sand beach and crystal blue sea, perfect for spending time out with the family.

…. Listening.

Slowing down.

7. What do you do at weekends?
Have fun.

8. If you were stranded on a desert island what 2 luxury items would you take?
A good book and a pair of sunglasses – I’m trying to learn the art of making the most of time to yourself!

9. I wish more people would take notice of…..
Litter – there’s no excuse for dropping it.

10. What is your guilty pleasure?
